PLEASE NOTE: As long as you are registered for this RFP you will continue to receive these notices. If you plan to not respond to this RFP with a proposal submittal, you may want to access the eProcurement Marketplace and mark "No Bid." Once you have done such, you will not continue to receive any notices pertaining to this RFP.

We have received the following request for information and hereby respond:

(1) QUESTION. Do you anticipate a significant increase in volume?

AGENCY RESPONSE. The Agency cannot fully predict the volume of work that will be ordered under any resulting legal services contracts awarded as a result of this RFP. As stated in RFP Document 1.0, Section 3.3.1- Quantities, the estimated hours are for calculating purposes only.

(2) QUESTION. Can you expand further on the nature of the work re: investigations?

AGENCY RESPONSE. Regarding the nature of the work for investigations: as needed, an investigation will be initiated by a request for an investigation from the Agency’s Human Resources (”HR”) department. The first step will be discussing the details of the allegation with the appropriate HR staff, followed by the investigating firm providing an investigative plan. The firm shall provide updates to HR regarding the progress of the investigation. The firm shall issue a report protected by the attorney-client privilege that documents the entire investigative process, including a summary of the allegation(s), the methodology used, a discussion of individuals interviewed and their credibility, an analysis of investigatory facts and evaluation of those fact’s significance in light of the Agency’s policies and standard operating procedures, and a complete discussion of findings. Supporting documentation such as transcriptions, recordings and other evidentiary material shall be provided to the Agency.

(3) QUESTION. Can you confirm that if our firm conducts the investigations, then we would be unable to conduct any resulting litigation?

AGENCY RESPONSE. If a firm conducts a workplace investigation regarding a complainant, then the same firm would not be able to represent the Agency in resulting litigation involving the same complainant, but the same firm would be able to represent the Agency in litigation involving other claimants.

(3) Please also see Attachment #1, attached hereto, regarding a prospective proposer’s requested revisions to RFP Attachment G, Sample Contract form, and other unspecified RFP documents.
