We have received the following request for information and hereby respond:
(1) QUESTION. As directed on p21 of the RFP, Sections 3.4.2 and 3.4.3, we have reviewed all requirements and submit the following exception re: the insurance language contained in 5.4.3 of the RFP and 4.4.2.2 of the sample contract: The RFP calls for professional liability insurance coverage “(minimum of $1,000,000 each occurrence, general aggregate minimum limit of $1,000,000), with a commercially reasonable deductible (e.g. “commercially reasonable,” meaning at least 1% of the “general aggregate minimum” of the policy, with a maximum deductible amount of $50,000.” Please note that [our firm’s] professional liability coverage under [our policy] has the following (higher) limits: an annual limit of $60,000,000 per claim and $120,000,000 in the aggregate; and the following deductible: self-insured retention under such Policy is $2,000,000 on each claim up to an aggregate of $4,000,000 and $100,000 each claim thereafter.
AGENCY RESPONSE. It is our assumption that the “exception” being requested pertains to the deductible amount. Our Agency declines to allow a maximum deductible amount of lower than the $50,000 maximum listed within the RFP.
(2) Please note the following CORRECTION to the RFP Document: Within Section 5.3 on Page 33of the RFP 1.0 Document, we hereby delete the wording “(for the Annual Updates)” listed within the 3 line of that Section, as this language has nothing to do with this RFP.
