PLEASE NOTE: As long as you are registered for this RFP you will continue to receive these notices. If you plan to not respond to this RFP with a proposal submittal, you may want to access the eProcurement Marketplace and mark "No Bid." Once you have done such, you will not continue to receive any notices pertaining to this RFP.
(1) EXTENSION OF DEADLINE. We hereby extend the following deadline pertaining to this RFP:
(1a) The Deadline to Ask Questions is hereby extended until 3:00 PM EST on Monday, April 22, 2019;
(1b) The Deadline to Submit a Proposal is hereby extended until 3:00 PM EST on Wednesday, May 1, 2019.
(1c) Please be aware that we acknowledge that we have recently received a number of questions that we feel are important to respond to.
(1d) For any firm that has already submitted a proposal, those proposals remain safe and sealed and no further action on the part of the firm is required.
(2) QUESTION. “Section 7.2, jurisdiction of law. Our firm would likely request an alternate location such as New York State. Would this be acceptable?â€
AGENCY RESPONSE. Jurisdiction must be Maine, as it is the locus (where the real estate is located).
(3) QUESTION. “Section 11.13. Attorney’s fees. Our firm would likely only agree to pay costs related to gross negligence and the maximum amount permitted would likely not exceed our fee.â€
AGENCY RESPONSE. Limiting attorney’s fees to gross negligence is not acceptable.
(4) QUESTION. “Our firm would likely request adjustments to the indemnification sections. I am waiting for guidance from our risk management department. Would any adjustments be acceptable?â€
AGENCY RESPONSE. Indemnification for acts of staff, etc. is standard. This is from HUD’s requirements. No adjustments to HUD’s language are allowed.
(5) QUESTION. What are the locations of the scattered site property?
AGENCY RESPONSE. All Scattered Site properties are located in the Portland downtown peninsula.
(6) QUESTION. “How is the office building operating, how many tenants does it have?â€
AGENCY RESPONSE. No office building is included in the RFP.
(7) QUESTION. “Are you requesting that our firm have a business license in Portland or in Maine? I don’t believe that is the case, but I want to confirm. Our firm has several offices across the country, but we do not have one in Maine. Does that in any way preclude us from bidding?
AGENCY RESPONSE. The firm need to be licensed to do business in the State of Maine prior to contracting.
(8) QUESTION. “I do not understand the following section [Section 3.3.2.1]. I do not expect that our fees would be unrealistically low but I am certain our firm would not agree to a cash bond for this purpose.â€
AGENCY RESPONSE. Section 3.3.2.1 is present to enable low bidders (usually small businesses) not to be written off as non-responsive for a low bid if they can provide assurances they will perform, or that any losses the Agency might suffer for their lack of ability to perform will be covered by a performance bond.
