PLEASE NOTE: As long as you are registered for this IFB you will continue to receive these notices. If you do not plan to respond to this IFB with a bid submittal, you may want to access the Internet System and mark “No Bid.” Once you have done such, you will no longer receive
any notices pertaining to this IFB.

The following questions and answers are hereby provided for clarification.

IFB Document Paragraph 2.3.1. Rates All-inclusive. Unless otherwise provided for herein, the fees bid shall be all-inclusive all other items, services and costs that the Contractor needs to complete the work, including but not limited to: tools; equipment; insurance; licensing; employee costs, including benefits; etc.
Q. Does this refer to tailgate delivery?
A. Yes.

IFB Document Paragraph 2.3.2. Time to Complete. Products shall be delivered within 4 days of the time of order.
Q. Is a 3 to 5 business day delivery time, with longer lead time for large orders, acceptable?
A. Yes, within reason.

IFB Document Paragraph 3.3.4.1 Potential Escalation of Product Rates. Likewise, at the discretion of the CO, at the end of the first one-year contract period (and at the end of any ensuing extended contract period), there may be an escalation of product costs allowed in the same amount of any escalation that occurs pertaining to the corresponding or most similar Producer Price Index (“most similar,” as determined by and at the sole discretion of the Agency). For example, if, at the end of the first contract period the listed prevailing producer price index (PPI; or similar, as determined) increase 5% as compared with the producer rates on the date of contract execution, then the Contractor will, at the CO’s discretion, be entitled to a 5% increase in the PPI that he/she submitted in response to this IFB. Similarly, for ensuing years, the end-date of the previous contract period shall be the base-line date to determine the previous listed wage rate.
Q. Is it acceptable for the successful Contractor to increase prices up to 5 percent each after the first year?
A. Contractor may request such an increase, but the Agency reserves the right to reject it (if the Agency feels it is unwarranted), and then conduct a new solicitation.

IFB Document Paragraph 3.6. Bidder’s Responsibilities — Equal Employment Opportunity and Supplier Diversity. Both the Contractor and the Agency have, pursuant to HUD regulation, certain responsibilities pertaining to the hiring and retention of personnel and subcontractors.
Note: The successful Contractor may be requested to provide a copy of the Company’s Equal Employment Opportunity and Supplier Diversity policies.

Q: May the successful Contractor request exceptions to the Contract provided as Attachment F to the IFB Document?
A: It is anticipated that the contract will be under the form of purchase orders rather than a full narrative contract. However, compliance with HUD Form 5370-C1 is required.

IFB Document Paragraph 5.2.3. Unauthorized Sub-Contracting Prohibited. The Contractor shall not assign any right, nor delegate any duty for the work proposed pursuant to this IFB (including, but not limited to, selling or transferring the contract) without the prior written consent of the CO. Any purported assignment of interest or delegation of duty, without the prior written consent of the CO shall be void and may result in the cancellation of the contract with the Agency, or may result in the full or partial forfeiture of funds paid to the Contractor as a result of the proposed contract; either as determined by the CO.
A. We have no subcontracting concerns with this IFB.

IFB Document Paragraph 5.4.2. General Liability Insurance. An original certificate evidencing General Liability coverage, naming the Agency as an, together with the appropriate endorsement to said policy additional insured reflecting the addition of the Agency as an additional insured under said policy (minimum of $1,000,000 each occurrence, general aggregate minimum limit of $1,000,000, together with damage to premises and fire damage of $50,000 and medical expenses any one person of $5,000), with a deductible of not greater than $5,000…
Note: Due to the nature of the work involved with any contract ensuing from this solicitation, it will be acceptable for the successful Contractor to merely list the Port Arthur Housing Authority as a certificate holder.

Q. Is the Port Arthur Housing Authority part of the City of Port Arthur?
A. No, we are a separate entity, though we have a close relationship with the City.

Q. Is the cost of tailgate delivery to be included in the prices bid?
A. Yes.

Q. What warranty is required for products purchased under a contract ensuing from this solicitation?
A. The manufacturer’s warranty applies, usually one year.

Q. Can the successful Contractor use subcontractors to deliver products under a contract ensuring from this solicitation?
A. Yes, but the Contractor is responsible for seeing that the products arrive on time and without damage.

Q. Will the Davis Bacon Act apply to any contract ensuring from this solicitation?
A. No.

Q. Will Section 3 apply to any contract ensuring from this solicitation?
A. No, because any such contract would involve providing and delivering already-manufactured products.
