We have received the following request for information and hereby respond:

(1) QUESTION. I have done several Housing Authority jobs in the past, in several states. I am currently doing 1 in Muncie, IN. Why wouldn't the Miller Act of 1935 take precedence in this case. It is a federally funded housing property.

By the way, I have a national Roofing License, It was acquired by passing the F13 exam through ICC, The International Code Council.

What is an F13 contractor (C)?
An F13 National Standard Residential Building Contractor (C) holds a license to construct, remodel, or repair any structure or addition. It is commonly referred to as a Residential Contractor (C) license. You are allowed to use a copy of the 2015 IRC and the ICC Concrete Manual when taking your F13 exam

the Miller Act of 1935.

The court noted federal subcontractors routinely bid on projects throughout the nation and often perform contracts that span multiple states. The court found requiring federal contractors to comply with contractor licensing requirements in any given state would be contrary to Congress’s intent in enacting the Miller Act, which was meant to reduce the hurdles placed on federal subcontractors, labor providers and materialmen in seeking payment. As a result, the court of appeal held that California’s licensing requirement is not a defense to a Miller Act claim, and reversed the judgment of the district court.
