Question:
My company does not meet MBE, WBE and DBE requirements. I also do not require any subcontractors. My company will provide all services for the job. Do I need to fill out pg. 16 (Waiver Request) of 30 MBE, Section 3 and EEO? If so, can you provide assistance in filling this form out? I am uncertain about the following sections, Waiver Requested For, Steps Taken to Meet Goals and Provide a Written Narrative.
Answer:
If a contractor will perform all of the work with their own employees and that subcontractor is not a certified MBE, WBE or DBE, then a waiver for the MBE, WBE and DBE goals is not required. But, make sure that the information is stated on M Section forms on pages 15, 16, 17, 21, and 22 that “No subcontractors will be used”. And, on pages 23 and 24 simply state “Not Applicable”. MBE, WBE and DBE contractors performing all of the work with their own employees will be required to complete pages 21 -22 and must include a copy of their certification documents in order to be considered for MBE, WBE or DBE participation. All contractors including sub-contractors must complete pages 18 and 20 for a successful bid package.
Section 3 does apply to this project. Please read the M Section, pages 25 – 30, carefully and be prepared to report the require hours and compliance with the priority schedules monthly during the course of the project.
